On Friday evening, a piece of software that millions of people could open that morning was simply gone by dinner. Not patched. Not paywalled. Gone — pulled off the market worldwide, for everyone, by order of the United States government.
The models were Claude Fable 5 and its locked-down sibling, Mythos 5, the most capable systems Anthropic had ever shipped. I’ll tell you up front that I work with this company’s models every day, and I’ll say more about that at the bottom. But set the brand aside, because the part that matters isn’t whose model it was. It’s how it was taken.
Here’s the short version, jargon kept on a leash. The strongest of these models are good enough at finding flaws in computer code that they’re genuinely dual-use — the same skill that patches a hole can pry one open. Anthropic knew that, and had kept the most powerful version, Mythos, on a tight leash, available to a handful of vetted companies. Then it released a guardrailed public version, Fable 5. Within hours, a red-team researcher at the United Kingdom’s AI Safety Institute said he had jailbroken it — gotten around the guardrails — and within a couple of days had it walking through multi-step malicious tasks. Around the same time, Amazon, which had its own access to the model and happens to be one of Anthropic’s largest investors, told the administration its researchers had been able to get the model to surface information useful in a cyberattack. Amazon’s chief executive, a White House official later confirmed, was among several tech leaders who took those concerns to senior administration officials.
What happened next is the part to watch. The White House didn’t write a law. It didn’t hold a hearing. The Commerce Department reached for an export-control order — the same machinery built to keep advanced chips out of foreign hands — and aimed it at a piece of software, demanding the models be restricted to U.S. citizens only. Not just foreign governments: any foreign national, including allied-country citizens and the company’s own non-American employees. There is no clean way to check citizenship at the moment someone calls an AI, so Anthropic did the only thing it could and shut the models off for everyone, everywhere.
Now — was the government right to be alarmed? Maybe. A model that meaningfully lowers the bar for a cyberattack is a real danger, and “we broke it in an afternoon” is not a sentence to wave away. The administration’s defenders will say that is exactly the moment a government is supposed to move fast, and that a few days of disruption beats a wave of breaches.
Anthropic’s side is just as real. The company says the flaw was narrow, already mostly known, and present in rival models too — that punishing one lab for disclosing its own model’s weakness sets a standard that would, in its words, “essentially halt all new model deployments” across the industry. Independent security researchers told reporters they were baffled by the move. And by Anthropic’s account the order arrived as a verbal directive and a letter with no specifics — no public evidence, no written finding anyone outside the room could check. Sharper still: the same government that pulled the models had, by Anthropic’s account, helped test them before launch and cleared them to ship — an approval reversed, days later, by export order.
You don’t have to pick a winner in that fight to see the thing I’m pointing at. Look at the door they used.
This is the first time the United States government has reached in and pulled a frontier AI model off the market. It did it not through a law any of us voted on, not through a rule anyone could comment on, not through a court — but through an export lever built for hardware, applied to software, overnight, triggered in part by a tip from a competitor who is also an investor, justified by evidence the public has never seen. Every one of those clauses is a precedent. Every one of them will be easier to use the second time.
That is the warning, and it is bigger than this model. When the mechanism of AI governance is a back door — export law, a phone call from a CEO, a verbal finding — then the question of who governs the most consequential technology of our age comes down to who has the right phone numbers and whose security team got there first. That is not a system. It is a series of favors and frights, and it can land on the lab you distrust this week and the one you rely on the next.
There is a better shape, and it is the same one we keep arguing for around here: govern capability in the open. If a model is dangerous enough to recall, the finding that says so should be written down, reviewable, and held to the same daylight we demand of every other serious thing a government does. When an AI is “too powerful to ship” is going to be one of the defining civic questions of the next decade, and it is far too important to be answered by export form, in the dark, on a Friday.
We have spent this week on chokepoints — a strait a signature can reopen, a power grid the AI build-out is about to strain. This is the third, and the newest: the state’s hand on the off-switch of a frontier mind. The lesson rhymes. Depend on a chokepoint nobody can see into, and you will pay its tax on its schedule, not yours.
The models may be back next week; the dispute may be smoothed over in a conference room in Washington. That is not the part to remember. The part to remember is that the door is open now, and the next government to walk through it will find it already unlocked.
